เกี่ยวกับความถดถอยของเสรีภาพสื่อมวลชนในสหภาพเมียนมาร์

สมาคมนักข่าวนักหนังสือพิมพ์แห่งประเทศไทย มีความวิตกกังวลเป็นอย่างยิ่งต่อคำตัดสินของศาลเมียนมาร์ในเขตมะเกว เมื่อวันที่ 10 กรกฎาคม 2557 ซึ่งสั่งจำคุกและใช้แรงงานนักข่าว 4 ราย และผู้บริหารของวารสารเดอะยูนิตี้ วีคลี่ นิวส์ เป็นเวลา 10 ปี ด้วยข้อหาบุกรุกเข้าไปในพื้นที่หวงห้าม ตามกฎหมายเกี่ยวกับความลับของทางราชการ คำพิพากษาดังกล่าวมีความเกี่ยวเนื่องกับรายงานของวารสารดังกล่าว เกี่ยวกับหน่วยงานทางการทหารซึ่งถูกกล่าวหาว่ามีการผลิตอาวุธเคมี
นอกจากนี้ ยังเป็นเรื่องน่าเศร้าที่นักข่าวเมียนมาร์คนอื่นๆ ซึ่งพยายามจะต่อสู้กับการลงโทษที่รุนแรงเกินกว่าเหตุนั้นจะต้องถูกตั้งข้อหาตามกฎหมายเกี่ยวกับการชุมนุมโดยสงบ
เหตุการณ์ที่เกิดขึ้นนี้ สะท้อนถึงความถดถอยของเสรีภาพสื่อมวลชนในเมียนมาร์ ซึ่งยังคงอ่อนไหวอยู่ และสร้างความหวาดกลัวว่าเมียนมาร์จะกลับไปมีการเซ็นเซอร์สื่ออย่างเข้มงวดอีกครั้ง
สมาคมนักข่าวนักหนังสือพิมพ์แห่งประเทศไทย ขอแสดงความเห็นใจต่อเพื่อนสื่อในเมียนมาร์ และขอเน้นย้ำความเชื่อที่ว่า วารสารศาสตร์ ไม่ใช่อาชญากรรม ความบกพร่องต่อวิชาชีพและประมวลจริยธรรมควรได้รับการแก้ไขด้วยความเคารพ ตามรัฐธรรมนูญของเมียนมาร์ ซึ่งรับรองเสรีภาพของสื่อมวลชนและเสรีภาพในการแสดงออก โดยเฉพาะในขณะที่เมียนมาร์มีกฎหมายด้านสื่อมวลชนที่กล่าวถึงสิทธิหน้าที่และความรับผิดชอบของสื่อมวลชนไว้อย่างชัดแจ้ง
สมาคมนักข่าวนักหนังสือพิมพ์แห่งประเทศไทย ขอร่วมเป็นส่วนหนึ่งกับเพื่อนสื่อมวลชนในเมียนมาร์ ในการต่อสู้กับการปฏิบัติที่ไม่เป็นประชาธิปไตยและหวังเป็นอย่างยิ่งว่าความเป็นอันหนึ่งอันเดียวกันนี้จะนำไปสู่ทางออกที่ดีที่สุดที่จะส่งเสริมและปกป้องเสรีภาพของสื่อในเมียนมาร์ และทั่วทั้งภูมิภาคต่อไป

Statement of Thai Journalists Association on the Declining State of Media Freedom in Myanmar

The Thai Journalists Association is alarmed and deeply concerned with the court decision in Magwe Division, Myanmar on 10 July to sentence four journalists and the chief executive officer of Unity Journal to 10 years of hard labor for violating Section 3 of the1923 State Secrets Act.
It was even more disheartening to hear that other fellow journalists who were trying to express concern about this unjust imprisonment are to be charged under Section 18 of the Assembly Act.
This signals a significant reversal of the progress of Myanmar’s fragile media freedom from previous advances in the past two years.
We share our sympathy with victims of this unwelcome situation and express solidarity with the rest of the media community in protecting media freedom in Myanmar.
We reiterate our firm belief that journalism is not a crime. And any lapse in professional code of conduct and ethics should be dealt within the framework of the new Press Law and with due respect of the Myanmar Constitution which guarantees freedom of express and freedom of the media and especially now that Myanmar has the Media Law that clearly spells out the media rights and responsibility.
We are ready to work with colleagues for promoting a free press environment in Myanmar and the rest of the region.
